Elizabeth Holmes booked a one-way flight to Mexico after the January 2022 conviction, US prosecutors say

SAN JOSE, California– Former Theranos CEO Elizabeth Holmes booked a one-way flight to Mexico following her January 2022 conviction, according to a new US government filing, ABC News reports.

The federal prosecutor’s filing contradicts Holmes’ request for release pending appeal.
In November 2022, Holmes was sentenced to 11 years and three months in prison after being convicted of four counts of fraud in January.

Prosecutors note that “it became known to the government on January 23, 2022” that Holmes had booked a flight to Mexico to depart on January 26, 2022 with no planned return trip.
Only after the government notified the defense of the unauthorized flight was the trip canceled.
Holmes’ partner Billy Evans left on January 26, 2022 and did not return for 6 weeks.
“The Government expects the Defendant will reply that it did not in fact leave the country as planned – but it is difficult to know for sure what the Defendant would have done if the Government had not intervened,” it says in the file.

The government adds that “another judge in that county analyzed several factors that are present here and found that the defendant failed to meet his burden of proving that he was not a risk of absconding.”
In the motion, the US government also states: “There are not two justice systems – one for the rich and one for the poor – there is one criminal justice system in this country. And under that system, the time has come for Elizabeth Holmes to answer for her crimes committed nearly a decade ago, as determined by a jury composed of a fair cross-section of individuals from that community, and the sentence handed down by that court sufficient but not more than necessary to serve those crimes.”
A response from Holmes’ team is likely.
Holmes, who is pregnant, was ordered to surrender to custody on April 27, 2023.
