These federal charges are separate from the state charges being pursued by the San Francisco District Attorney’s Office and are being treated as separate cases, according to a US Attorney’s Office representative.

He is being held without bail for attempted murder, burglary and elder abuse, to which he has also pleaded not guilty.

In a federal complaint, officials said DePape broke into the Pelosis’ Pacific Heights home carrying zip ties, duct tape and a piece of rope in a backpack. He went upstairs to where 82-year-old Paul Pelosi was sleeping and demanded to speak to “Nancy.”

Paul Pelosi was released from hospital on November 3 after undergoing surgery for a fractured skull and other injuries from the attack. Prosecutors with the San Francisco State Attorney’s Office say he was knocked unconscious when he was hit with a hammer and woke up in a puddle of his own blood at the family home.

Two officers who ran to the home after Paul Pelosis called 911 saw DePape hit him at least once with the hammer, hitting him in the head, officials said.

DePape’s next appearance in federal court is November 30.

December 14 is the date for the preliminary hearing in the public prosecutor’s proceedings.
