These federal charges are separate from the state charges being pursued by the San Francisco District Attorney’s Office and are being treated as separate cases, according to a US Attorney’s Office representative.

He is being held without bail for attempted murder, burglary and elder abuse, to which he has also pleaded not guilty.

Two officers who ran to the home after Paul Pelosis called 911 saw DePape hit him at least once with the hammer, hitting him in the head, officials said.

DePape’s next appearance in federal court is November 30.
